1. Introduction
These Terms of Service govern access to and use of fragmentednl.com, including all purchases made through the website.
The website and online store are operated by:

Throughout these Terms, “Fragmented Music,” “we,” “us” and “our” refer to Fragmented Music. “Customer,” “you” and “your” refer to any individual who visits the website, creates an account or purchases a product through the website.
By using the website or placing an order, you agree to these Terms of Service, our Return and Refund Policy and our Privacy Policy.
Nothing in these Terms limits any mandatory consumer rights granted under Dutch, European Union or other applicable consumer-protection law.
2. Eligibility
The website is intended for consumers purchasing products for personal use.
Customers under the age of 18 may use the website and place an order only with the permission and supervision of a parent or legal guardian.
By placing an order, the customer confirms that:
the information provided is complete and accurate;
the customer is legally permitted to enter into the purchase agreement; and
where the customer is under 18, permission has been obtained from a parent or legal guardian.
Fragmented Music may refuse or cancel an order where there are reasonable grounds to believe that the customer lacks the legal capacity or necessary permission to enter into the agreement.
3. Products
Fragmented Music sells clothing, accessories, home products and other merchandise through fragmentednl.com.
Most or all products are manufactured on demand. Fragmented Music does not normally hold physical stock.
Products may be produced, packaged and shipped directly by third-party fulfilment partners, including:
Printify;
PODpartner; and
production or shipping partners selected through those services.
Although a third-party fulfilment partner may manufacture or deliver the product, the customer’s purchase agreement remains with Fragmented Music.
Fragmented Music remains responsible for fulfilling its legal obligations as the seller.
4. Product images and descriptions
Fragmented Music makes reasonable efforts to display product descriptions, measurements, colours, materials and images accurately.
However, the final product may differ slightly from the images shown on the website. Such differences may result from:
screen and display settings;
different production facilities;
variations in materials;
manufacturing tolerances;
print placement;
print dimensions;
colour reproduction;
lighting used in product photography; or
product updates by a fulfilment partner.
Minor variations that do not materially affect the product’s appearance, quality or intended use will not automatically constitute a defect.
Nothing in this section permits Fragmented Music to provide a product that materially differs from its description or fails to conform to the purchase agreement.
5. Product sizing
Size charts are provided on most product pages.
Customers are responsible for reviewing the applicable size chart and selecting the appropriate size before completing an order.
Sizing may vary between product types, manufacturers and fulfilment locations. A customer should not assume that the same labelled size will have identical measurements across every product.
Selecting an incorrect size does not by itself make the product defective. The customer may nevertheless use any applicable return or withdrawal rights described in the Return and Refund Policy.
If the product received materially differs from the measurements or sizing information provided on the relevant product page, the customer should contact Fragmented Music.
6. Product availability
All products are subject to availability.
Because products are manufactured through third-party fulfilment partners, a product or production variant may become unavailable after an order has been placed.
If an ordered product becomes unexpectedly unavailable, Fragmented Music may:
offer a suitable replacement, subject to the customer’s agreement; or
cancel the unavailable product and issue a refund to the original payment method.
The customer will not be required to accept a replacement.
Where only part of an order is unavailable, Fragmented Music may fulfil the remaining products and refund the unavailable part.
7. Orders and contract formation
Products displayed on fragmentednl.com constitute an invitation for customers to place an order and do not by themselves create a binding agreement.
By completing checkout, the customer submits an offer to purchase the selected products.
After an order is submitted, the customer may receive an automated order acknowledgment. This confirms that the order has been received but does not necessarily mean that it has been accepted.
An order is accepted when Fragmented Music:
sends an order confirmation;
begins production or fulfilment; or
otherwise confirms that the order has been accepted.
Fragmented Music reserves the right to refuse or cancel an order before acceptance where reasonably necessary, including where:
a product is unavailable;
payment is unsuccessful;
the customer’s information is incomplete or inaccurate;
the order appears fraudulent;
the order appears to involve unauthorised commercial resale;
a quantity limit has been exceeded;
there is an obvious pricing or product-description error; or
fulfilment or delivery to the supplied address is not reasonably possible.
If payment has already been collected for an order that is refused or cancelled, the applicable amount will be refunded to the original payment method.
8. Payment
Full payment is required when the order is placed.
Available payment methods may include:
credit cards;
debit cards;
Mastercard and other supported card networks;
PayPal;
Apple Pay;
Google Pay; and
other payment methods displayed at checkout.
The payment methods actually available may depend on the customer’s country, device, currency and payment provider.
Payments may be processed through Squarespace Payments, Stripe, PayPal or another payment service made available through the website.
Fragmented Music does not directly receive or store complete payment-card details where those details are processed securely by a payment provider.
The customer confirms that they are authorised to use the selected payment method.
Fragmented Music may suspend, refuse or cancel an order if payment is:
declined;
reversed;
disputed;
identified as potentially fraudulent; or
not successfully completed.
9. Prices
Prices are displayed in the currency indicated on the website or at checkout.
The final checkout page will display the product price and applicable delivery charges before the customer places the order.
Where applicable, taxes may be calculated based on the customer’s delivery destination.
Prices may change at any time. Price changes do not affect orders that have already been accepted, except where there is an obvious and recognisable error.
Fragmented Music is not required to fulfil an order at a clearly incorrect price where the customer knew or could reasonably have understood that the price was an error.
If a pricing error is discovered after an order has been placed, Fragmented Music may contact the customer to:
offer the product at the correct price; or
cancel the affected product and issue a refund.
10. Discount codes and promotions
Discount codes and promotional offers are subject to the conditions stated with the relevant offer.
Unless otherwise stated:
a discount code applies only to eligible products;
only one discount code may be used per order;
discount codes cannot be exchanged for money;
discount codes cannot be applied after an order has been completed;
promotional discount codes may expire;
discount codes may not be combined with other promotions; and
discount codes may be restricted by customer, country, product, order value or period.
A personal discount code issued directly by Fragmented Music will not expire unless:
an expiry date was communicated when the code was issued;
the code has been replaced;
the code was issued in error;
the code is being misused; or
continued use would result in fraud, abuse or a technical malfunction.
Fragmented Music may withdraw, correct or refuse a code where there is evidence of:
fraud;
unauthorised distribution;
automated use;
duplication;
misuse;
a technical error; or
use contrary to the stated conditions.
This section does not affect completed orders that were accepted using a valid code, except in cases of fraud or an obvious technical error.
11. Production
Products are generally manufactured after the order has been accepted.
The estimated production period is up to three to four business days.
Business days ordinarily exclude Saturdays, Sundays and public holidays applicable to the relevant production facility.
Production times are estimates and not guaranteed deadlines.
Production may occasionally take longer due to:
high order volumes;
product availability;
production quality checks;
replacement of a failed print;
technical problems;
public holidays;
supplier interruptions; or
circumstances outside the reasonable control of Fragmented Music.
12. Shipping and delivery
After production, estimated shipping usually takes approximately two to seven business days, depending on:
the delivery destination;
the production facility;
the shipping service;
carrier capacity;
customs procedures; and
local delivery conditions.
Production and shipping periods are separate. A typical order may therefore require the estimated production period plus the estimated shipping period.
All delivery periods shown on the website, at checkout or in order communications are estimates unless Fragmented Music expressly confirms a guaranteed delivery date in writing.
Fragmented Music will make reasonable efforts to deliver within the estimated period.
A delivery estimate does not make time of the essence and does not automatically entitle the customer to compensation for a delay.
This does not restrict any statutory right the customer may have where an order is not delivered within an agreed or legally required period.
13. Delivery address
The customer is responsible for providing a complete and correct delivery address.
Before placing an order, the customer should verify:
the recipient’s full name;
street name and house number;
apartment, unit or access information;
postal or ZIP code;
city;
region or state;
country;
telephone number; and
any other information required for delivery.
Fragmented Music is not responsible for a delivery failure caused by inaccurate or incomplete information supplied by the customer.
If the customer notices an address error, the customer must contact Fragmented Music immediately.
Address changes cannot be guaranteed after the order has entered production or fulfilment.
Additional expenses caused by incorrect customer information, including return shipping and reshipping charges, may be charged to the customer where legally permitted.
14. Separate shipments
Products in the same order may be manufactured at different facilities or fulfilled by different partners.
An order may therefore arrive in more than one parcel and on different delivery dates.
Separate delivery does not mean that products are missing, provided the remaining products are still in transit or scheduled for fulfilment.
Where available, tracking information may be issued separately for each parcel.
15. Customs, duties and import charges
International orders may be subject to:
import duties;
customs charges;
value-added tax;
sales tax;
brokerage fees;
handling charges; or
other government-imposed costs.
Unless the website or checkout expressly states that such charges have already been collected, the customer is responsible for paying them.
Fragmented Music does not control charges imposed by customs authorities, carriers, governments or other third parties.
Customers are responsible for checking the import requirements of their country before ordering.
Failure to pay customs or import charges may cause the parcel to be delayed, refused, destroyed or returned.
Any refund following such a return will be handled in accordance with the Return and Refund Policy and applicable law. Reasonable costs caused by non-payment of import charges may be deducted where legally permitted.
16. Order cancellation
Customers may request cancellation within 36 hours after placing an order by emailing:
A cancellation request is not effective until Fragmented Music confirms it.
Because products may be sent to production automatically, Fragmented Music cannot guarantee that an order can still be cancelled within the 36-hour period.
Once production, fulfilment or shipment has begun, the order may no longer be cancellable before delivery.
If cancellation is no longer possible, the customer may use any applicable withdrawal or return rights after delivery.
This section does not restrict the customer’s statutory right of withdrawal.
17. Returns and right of withdrawal
Returns, refunds, replacements and the right of withdrawal are governed by the separate Return and Refund Policy published on fragmentednl.com.
Fragmented Music offers a voluntary 30-day return period, subject to the conditions stated in that policy.
Consumers in the European Union or European Economic Area generally also have a statutory right to withdraw from eligible online purchases within 14 calendar days after receiving the products.
To start a return or notify Fragmented Music of withdrawal, the customer should contact:
Customers must follow the return instructions provided by Fragmented Music.
The voluntary return policy does not restrict statutory consumer rights.
18. Refused and uncollected parcels
Refusing delivery or failing to collect a parcel does not automatically constitute a valid cancellation or exercise of the right of withdrawal.
Customers wishing to cancel or withdraw must clearly communicate that decision to Fragmented Music.
Where a parcel is returned because it was:
refused;
not collected;
incorrectly addressed by the customer;
subject to unpaid import charges; or
otherwise undeliverable for reasons attributable to the customer,
Fragmented Music may deduct reasonable delivery, return, customs, handling or reshipping expenses from any refund, where legally permitted.
The customer may be required to pay the reshipping costs before another delivery attempt is made.
Nothing in this section permits Fragmented Music to retain amounts that must legally be refunded.
19. Defective, damaged or incorrect products
Fragmented Music is responsible for ensuring that products conform to the purchase agreement.
If a product is damaged, defective, misprinted, incomplete or materially different from what was ordered, the customer should contact Fragmented Music as soon as reasonably possible.
The customer should provide:
the order number;
a description of the problem;
photographs of the product;
photographs of the packaging, where relevant; and
any other information reasonably required to investigate the issue.
Depending on the circumstances and applicable law, Fragmented Music may offer:
repair;
replacement;
reprinting;
a price reduction;
cancellation of the affected product; or
a refund.
Where Fragmented Music is legally responsible for the problem, the remedy will be provided without additional cost to the customer.
A customer’s statutory guarantee and conformity rights are separate from the voluntary 30-day return period and are not limited by it.
20. Replacement and reprint requests
Customers may request a replacement or reprint within 30 calendar days after receiving the product.
A replacement or reprint may be offered where:
a product arrived damaged;
a printing error occurred;
the wrong product was delivered;
the product was incomplete;
the parcel was lost in transit and confirmed as lost; or
another fulfilment issue occurred.
Fragmented Music may require evidence before approving a replacement or reprint.
Approval depends on the circumstances, product availability and the customer’s applicable legal rights.
A replacement or reprint request does not automatically entitle the customer to keep both the original product and a refund.
21. Customer accounts
Customers may be able to create an account through fragmentednl.com.
The customer is responsible for:
maintaining the confidentiality of account login information;
providing accurate account information;
updating information when it changes; and
notifying Fragmented Music of suspected unauthorised account access.
The customer must not:
access another person’s account without permission;
create an account using false information;
use an account for fraud or unlawful activity; or
interfere with the website or other accounts.
Fragmented Music may suspend or close an account where reasonably necessary to prevent fraud, misuse, security risks or violations of these Terms.
Closing an account does not remove payment obligations or affect orders already placed.
22. Intellectual property
All intellectual property rights in or relating to Fragmented Music and fragmentednl.com are owned by, licensed to or otherwise lawfully used by Fragmented Music.
This includes, where applicable:
the Fragmented Music name;
logos;
trademarks;
product designs;
artwork;
album artwork;
music-related branding;
photographs;
graphics;
illustrations;
videos;
written content;
website layouts;
product descriptions; and
other original materials.
Customers receive no ownership rights in this intellectual property by visiting the website or purchasing a product.
Customers may view the website and make limited personal use of its content.
Without prior written permission from Fragmented Music, customers may not:
copy;
reproduce;
publish;
modify;
distribute;
license;
sell;
commercially exploit;
create derivative works from;
remove ownership notices from; or
use Fragmented Music content or designs for artificial-intelligence training or commercial datasets.
Nothing in these Terms transfers any intellectual property right to the customer.
23. Resale
Customers may resell individual genuine products they lawfully own where permitted by applicable law.
However, purchasing products for organised or commercial resale, wholesale distribution, reproduction, merchandising or representation as an authorised seller requires prior written permission from Fragmented Music.
Customers may not:
present themselves as an official Fragmented Music retailer;
use Fragmented Music branding to imply sponsorship or authorisation;
reproduce Fragmented Music designs;
sell counterfeit products;
remove or alter authenticity or ownership markings; or
use product images commercially without permission.
Fragmented Music may limit quantities or cancel orders reasonably suspected of unauthorised commercial resale.
This section does not restrict statutory rights that cannot legally be excluded.
24. Prohibited use
Customers may not use the website:
for unlawful, fraudulent or harmful purposes;
to violate intellectual property rights;
to distribute malware or malicious code;
to interfere with the security or operation of the website;
to scrape or collect data through unauthorised automated means;
to impersonate another person;
to submit false payment or delivery details;
to make fraudulent claims;
to test stolen payment credentials;
to evade purchase restrictions; or
to place orders for prohibited commercial resale.
Fragmented Music may restrict website access, cancel orders or take other reasonable measures where a customer violates this section.
25. Fraud prevention
Fragmented Music and its payment partners may use fraud-prevention and identity-verification systems.
An order may be held, reviewed, refused or cancelled where:
payment information cannot be verified;
the billing and delivery information raises security concerns;
automated fraud systems identify a heightened risk;
unusual purchasing activity is detected; or
further information is reasonably required.
Fragmented Music may request reasonable verification before accepting or fulfilling an order.
Fragmented Music will process personal data used for fraud prevention in accordance with its Privacy Policy and applicable data-protection law.
26. Third-party services
The website relies on third-party providers, which may include:
Squarespace;
Squarespace Payments;
Stripe;
PayPal;
Apple Pay;
Google Pay;
Printify;
PODpartner;
shipping carriers;
tax-calculation services;
fraud-prevention providers; and
analytics or website-functionality providers.
The availability of the website and fulfilment of orders may depend partly on these providers.
Fragmented Music is not responsible for the independent websites, services, privacy practices or content of third parties.
This does not remove Fragmented Music’s responsibility to the customer for obligations that legally remain the seller’s responsibility.
27. External links
The website may contain links to websites, music platforms, social-media services or other resources operated by third parties.
These links are provided for convenience or informational purposes.
Fragmented Music does not control and does not necessarily endorse third-party content.
Customers access third-party websites at their own discretion and should review the relevant third party’s terms and privacy policies.
28. Website availability
Fragmented Music aims to keep fragmentednl.com available and accurate but does not guarantee uninterrupted or error-free access.
The website may be temporarily unavailable due to:
maintenance;
hosting interruptions;
technical failures;
cybersecurity measures;
third-party service problems;
updates; or
circumstances outside Fragmented Music’s reasonable control.
Fragmented Music may change, update, suspend or discontinue website features.
Where reasonably possible, such changes will not affect orders already accepted.
29. Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
In particular, these Terms do not exclude liability for:
death or personal injury caused by negligence where such liability cannot be excluded;
fraud or fraudulent misrepresentation;
intentional misconduct;
gross negligence where it cannot legally be limited;
failure to provide products that conform to the agreement;
mandatory consumer guarantees; or
any other liability that cannot legally be excluded.
To the extent permitted by law, Fragmented Music is not liable for:
indirect or consequential losses;
loss of profit, revenue or business opportunity;
business interruption;
losses arising from commercial use of products purchased as a consumer;
losses caused by incorrect information supplied by the customer;
delays caused by customs, carriers or force-majeure events;
unauthorised use of a customer account; or
losses that were not reasonably foreseeable when the agreement was made.
Where liability may legally be limited, Fragmented Music’s total liability relating to an order will generally not exceed the total amount paid for the product or order giving rise to the claim.
This limitation does not apply where a higher amount is required under mandatory law.
30. Proper use of products
Customers must use products in accordance with:
the product description;
care instructions;
washing instructions;
safety warnings; and
reasonable common use.
Fragmented Music is not responsible for damage caused by:
failure to follow care instructions;
improper washing or drying;
modification of the product;
misuse;
accidental damage;
normal wear and tear; or
use for a purpose for which the product was not intended.
This section does not apply where the damage was caused by an existing defect or non-conformity for which Fragmented Music is legally responsible.
31. Force majeure
Fragmented Music is not liable for delays or failure to perform caused by circumstances outside its reasonable control.
Such circumstances may include:
natural disasters;
severe weather;
fire;
flooding;
epidemics or pandemics;
war;
terrorism;
civil unrest;
government restrictions;
sanctions;
customs delays;
carrier interruptions;
strikes;
labour disputes;
power failures;
internet or hosting failures;
cyberattacks;
shortages of materials;
failure of a production partner; or
disruption of international transport.
Where such an event occurs, Fragmented Music may suspend performance for the duration of the event.
If fulfilment becomes impossible or the delay becomes excessive, Fragmented Music may cancel the affected order and refund the amounts paid for undelivered products.
This section does not restrict any mandatory customer right to terminate an agreement following a legally significant delay.
32. Complaints
Customers may submit complaints by emailing:
The complaint should include:
the customer’s name;
the order number, where applicable;
a clear explanation of the complaint;
the requested resolution; and
relevant evidence or photographs.
Fragmented Music aims to acknowledge or respond to complaints within 48 hours.
The 48-hour period is an operational target and may be extended during weekends, public holidays, unusually high volumes or where further investigation is required.
Fragmented Music will seek to resolve complaints within a reasonable period.
33. Privacy
Personal data is processed in accordance with the Fragmented Music Privacy Policy.
The Privacy Policy explains how personal information may be collected, used, shared, retained and protected in connection with:
website use;
customer accounts;
payments;
order fulfilment;
delivery;
customer service;
fraud prevention;
analytics; and
marketing communications.
Customers should read the Privacy Policy before placing an order or creating an account.
34. Changes to these Terms
Fragmented Music may update these Terms from time to time.
The updated version will be published on fragmentednl.com with a revised “Last updated” date.
Changes will generally apply to use of the website from the date of publication.
The Terms in effect when an order was placed will continue to govern that order unless:
a change is required by law;
the customer expressly agrees to the change; or
applying the new provision is more favourable to the customer.
Fragmented Music will not retroactively remove mandatory rights from an existing order.
35. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.
The remaining provisions will continue in effect.
The invalidity of one provision does not invalidate the entire Terms of Service.
36. No waiver
If Fragmented Music does not immediately enforce a right or provision under these Terms, this does not mean that the right or provision has been waived.
Any waiver must be clear and applies only to the specific circumstances in which it was given.
37. Entire agreement
These Terms, together with the applicable:
order confirmation;
product information;
Return and Refund Policy;
Privacy Policy; and
any specific promotional conditions,
form the agreement between Fragmented Music and the customer concerning an order.
Where specific written product or promotional terms conflict with these general Terms, the more specific terms will apply to the extent of the conflict, provided they comply with applicable law.
38. Governing law
These Terms and purchase agreements made through fragmentednl.com are governed by the laws of the Netherlands.
Where the customer habitually resides in another country, this choice of law does not deprive the customer of mandatory consumer protections granted under the laws of that country where those protections apply.
39. Disputes
Customers are encouraged to contact Fragmented Music first so that a dispute can be addressed directly.
If a dispute cannot be resolved, it may be submitted to a court with jurisdiction under applicable law.
A consumer may be entitled to bring proceedings in the country where the consumer habitually resides.
Nothing in these Terms requires a consumer to give up a court, complaint or dispute-resolution right granted under mandatory law.
